The Cyberspace Administration of China, the Ministry of Industry and Information Technology, and the State Administration for Market Regulation jointly issued the Regulations on Management of Internet Pop-Up Information Push Services (hereinafter referred to as “Regulations”), effective May 30, 2019. came into effect on September 01, 2022. The regulations aim to solve the problem of using pop-up windows to illegally push news information, advertisements that cannot be closed with one click, malicious hype for entertainment gossip, etc. to the Administration from pop-up information pushes to regulate services.
The Regulations clarify the definition of “Internet pop-up information push services” as information push services provided to Internet users in the form of pop-up message windows through operating systems, application software, websites, etc. -up push services refer not only to traditional computer and mobile phone terminals, but also includes network television, lunch cabinets, express cabinets, etc., which fall within the scope of the above definition.
The regulations stipulate that Internet pop-up information push service providers take primary responsibility for information content management and establish and improve management systems such as information content verification, environmental governance, data security and personal data protection, and the protection of minors.
In addition, the regulations clarify the specific requirements for providers of Internet pop-up information services. Those who provide Internet pop-up information push services shall not disclose illegal and bad information, as stipulated in the network information content ecological governance regulations; must not trick users into clicking through the pop-up information push services; must protect the rights and interests of users, fully consider the user experience, scientifically plan the push frequency, do not take unreasonable differential measures against ordinary users and member users, and do not disturb or influence the user to close the pop-up window of any form, taking the pop-up information uniquely identifying the provider of the pop-up window information push service; ensures that pop-up ads are recognizable and can be closed with one click; and may not present any information that maliciously redirects traffic to them, such as B. Third-party links, QR codes, etc., via pop-up information push.
