SC judge Mazahar Naqvi’s sons are serving the lawyer with a defamation complaint

ISLAMABAD: Supreme Court sons Sayyed Mazahar Ali Akbar Naqvi have served a legal notice on Mian Dawood and requested a public apology for her defamation within 15 days, The News reported on Sunday.

Attorney Dawood had filed a misconduct complaint against Judge Naqvi with the Supreme Judicial Council (SJC), stating that the judge and his family members were engaged in a criminally planned pattern of misconduct and abuse of power during his tenure.

The complaint was filed to seek the removal of Judge Naqvi after his name surfaced in connection with recent audio leaks allegedly involving him, former Punjab Prime Minister Parvez Elahi, and others.

The lawyer further alleged that the judge used his position to facilitate his sons and daughter’s studies abroad and to make financial gains from Zahid Rafique.

In the legal notice, Sayed Tassaduq Mustafa Naqvi and Sayed Tassaduq Murtaza Naqvi – sons of Judge Naqvi – invited the applicant to issue a public apology within 15 days.

“You must also issue a corrigendum in the same way and manner, otherwise prepare to take legal action (civil and criminal) for damaging the undersigned’s reputation as an integral part of a respected entity,” the legal notice says.

“Such proceedings shall include, among other things, an action for damages (including all costs, etc.) and such remedies shall be without prejudice to any other remedies to which the signatory is entitled by law,” the legal notice added.

Both brothers described the applicant’s allegations as criminally motivated and as an attempt to blackmail and defame them.

“All you’ve done is reveal yourself as a jealous, hateful man in a crisis, waging malicious campaigns against people you can’t even dream of standing by,” the brothers explained, adding that the Actions are punishable by law.

“In response to your allegations, we have been informed that the undersigned(s) hold a bachelor’s degree in law from the University of London, a master’s degree in law from Indiana University Bloomington and a specialization in business and commercial law,” so the brothers stated.

They further stated that they have been practicing in Lahore High Court (LHC) since August 2017 and are fully financially independent.

The brothers explained that the applicant could not even be called a lawyer, since he had not even attended law school, adding that this was a blatant violation of the laws and rules applicable to lawyers on the one hand and on the other he presented himself as a lawyer Lawyer and also operates media platforms for his public clad in despondency and shame.

“Before pointing your finger at the signer(s), provide us with evidence of your career as a legal practitioner and explain exactly how you became a lawyer,” the brothers urged the applicant.

Responding to the legal notice, Dawood said the decision to respond or not to respond to the legal notice would be made after consultation with his legal friends.

He said he would not bow to the threats because of the primacy of the law and the constitution, adding that they should submit their responses to the Supreme Judicial Council on corruption instead of hiding behind the legal notice.
